General Marina and Tennis Rules
1. Marina and Tennis privileges are for the exclusive use of Members and their guests. A Member must always accompany a guest while the guest is using the community facilities.
2. Members accept full responsibility and liability for themselves, their family and guests while using the community facilities and uses these facilities at their own risk. The Association accepts no liability for the loss or damage to personal property or for personal injury suffered by individuals using the community facilities.
3. Each Member will be permitted no more than six guests at the community property and facilities and such guests must be accompanied by an adult Member. Persons under 16 years of age shall not be allowed access to the community facilities after 10 PM unless accompanied by an adult Member.
4. If Members wish to host a larger group of guests for a special event, they are requested to notify the Marina Committee or the Recreational Committee not less than two weeks in advance with: the number of guests anticipated, the date and duration of their visit, and accept responsibility for the clean-up of the community facilties upon completion of the event. The Marina Committee or the Recreational Committee may grant approval of such speacial events to the extent that they do not conflict with the community's desired use of the facilities or with events previously scheduled by other Members of the Association.
5. The Board of Directors shall adopt rules relating to the use and the distribution of keys for access to the community facilities, including the Marina gate, docks, tennis courts and restrooms. Members are required to ensure the safe keeping of such keys, shall not duplicate such keys and shall not transfer such keys to any other person. Members violating the key policy many be subject to the cost of replacement of locks and keys. Members shall lock all gates accessed by a key.
6. The community facilities shall be maintained by Members using the faciltiies in a neat, clean and orderly manner. Trash shall be placed in receptacles.
Marina Rules
7. Berthing at the Marina docks is restricted exclusively to boats owned by Members or those exceptions approved by the Board. The Board shall have the discretion to limit the type and size of boats in keeping with the community standards.
8. The Harbor Master (chairman of the Marina Committee) will assign boat slips so as to make safe and efficient use of dock space. To this end, some annual adjustments to slip assignments many be required. The Harbor Master will have final decision authority in any disputes over slip assignments.
9. Slips will be assigned only to eligible, paid Members of the Association who own and possess a boat. Members will not be assigned a slip in anticipation of purchase of a boat at some future date. Slips are subject to compliance with Marina registration form requirements which shall include evidence of ownership, Marina insurance and agreement to comply with the Marina rules.
10. To the extent that slips are available, each Member will be entitled to no more than one slip. If there are unassigned slips, the Harbor Master may grant temporary assignment of a slip for a Member's second boat.
11. All boats moored at the Marina will, at a minimum, comply with Coast Guard and State registration requirements and regulations concerning life preservers, fire extinguishers, and other safety provisions. Any craft deemed seaworthy by the Marina Committee may be required to pass a suitable inspection. Failure to comply with this requirement will result in the cancellation of berthing privileges.
12. Marina slips may not be used for the long-term storage of hulks or in-active boats. Only minor repair or maintenance not exceeding a few days will be permitted in the Marina.
13. Maximum length of assigned boats will not exceed 30 feet for interior slips. Boats must be moored so as not to protrude beyond the pilings into the Marina channel.
14. Boats berthed in the Marina are the responsibility of the individual owners; however, in the event of an emergency, i.e.. breakdown of bilge pumps, leaks, bad lines, fire, etc., in the owner's absence, the Harbor Master, other Board Members, or other Association Members are authorized to take necessary emergency action. In no event will the acting individual or the Association be held responsible for any consequences resulting from emergency action taken or the lack of such action.
15. Unless posted, a maximum speed of five (5) MPH is hereby established within a reasonable and prudent distance of the Marina.
16. Boats returning to the Marina will have the right-of-way over boats departing the narrow dredged channel.
17. Modifications to docks, pilings, plumbing or electrical circuitry are prohibited.
18. Swimming from docks or jumping off pilings or other Marina areas is prohibited.
19. Open flame cooking on docks or boats berthed in the Marina is prohibited.
20. Petroleum products or toilets (heads) will not be flushed or emptied into the Marina.
21. No materials, including petroleum products, shall be stored on the docks or in the Marina area.
22. Access to the Marina driveway and parking areas will be controlled by a locked gate or chained entrance. Each Member will be responsible for keeping the access secure.
23. Parking within the Marina area is limited exclusively to Members while using the Marina facilitiy. Storage of cars, recreation vehicles, trucks or other vehicles is strictly prohibited.
24. Parking is restricted to the paved and graveled areas only and should not obstruct access to the ramp or trailer parking area. Driving or parking on the grass is prohibited.
25. Boat trailers and boats on trailers of Members which dispaly the Assocation sticker may be parked in the areas designated for this purpose. Storage of boats on boat trailers and boat trailers must be authorized in advance by the Harbor Master, including establishing ownership and insurance. No hulks or inactive boats or trailers may be parked in the Marina area. Only minor maintenance and repairs lasting not more than a few days may be performed in the Marina parking area. Boat cradles are not permitted in the Marina.
26. Motorized vehicles or boat trailers which are not licensed to operate on public roads are prohibited from operating on Marina property.
27. The ramp is for the exclusive use of Members and their guests without charge. Guest usage will be allowed only in the presence of the host Members.
28. Members using the boat ramp shall not power their boat onto their trailer.
Tennis Court Rules
29. The tennis courts are only for the use of Members and their accompanied guests. Nonresidents will not use the courts unless specifically invited and accompanied by a Member during their entire stay on the courts.
30. The courts will be available for play at 8:00 AM and will close at 9:00 PM.
31. The courts must be kept locked when not in use. Enter the gate for the court you are using. The person unlocking the court is responsible for locking the court upon their departure. The vehicular gate to the Marina must be locked after you use it to enter or leave the Marina.
32. Climbing the fences and tampering with the net are prohibited.
33. No food, drink, animals, small children, vehicles, roller blades, skates, skateboards, hopscotch, chalk drawing, or ball games of any sort are allowed on the courts.
34. No profanity is allowed. Use good manners and be considerate of the other court and of the houses close by.
35. Proper tennis shoes with nonmarking soles are required. Suitable attire and shirts are required.
36. The courts will be used on a first-come, first-serve basis. If needed, a family may reserve through the Recreational Committee one court per week. Court 1 will have a one-hour limit on it and Court 2 will have a 90-minute limit on it. If you are reserving time for doubles, you would reserve Court 2; if you are reserving time for singles, you would reserve Court 1. Reservations will be allowed on weekdays only, and the reservation schedule may be posted at the courts at the discretion of the Board.
37. Established priorties for court use are: (a.) neighborhood programs or clinics; (b.) reservations; and (c.) first-come, first-served - turnover on the hour for Court 1 or the hour and a half for Court 2 unless no one is waiting.
38. You may make a reservation for planning purposes, but the intention is that the courts will be available as often as posssible for free play.
39. These rules will be closely monitored and are subject to change. All comments and rule violations should be reported in writing to the Board.
